RESORT RULES AND REGULATIONS


        11. Security bands will be provided to each occupant of each unit listed on the check in documents
            that are above the age of 5. Security bands are to be worn while on the property. Daytime guests
            must obtain a guest security band from the front office as well. Those found not to be wearing the
            security band on thier wrist will receive a warning for the first infraction and will be fined in
            accordance with resort bylaws at a rate of $25.00 for each and all subsequent violations. If
            someone on property continues to violate  this policy, they will be asked to leave the common

        12. Rules and Regulations as to the use of the pool/spa and facilities shall be posted as specified in
            the by-laws of the condominium association and each unit owner, etc., shall observe all rules and
            regulations relating thereto. Towels or other articles will not be placed on any chairs or lounges in
            attempt to save said chairs for later use. They will be removed prior to pool opening hours or if left
            for longer than 1 hour unattended.

        13. Regardless of age, no condominium unit shall be occupied by more than four (4) people in the
            North building and six (6) in the South building at any one time without prior written approval of the
            management firm.

        14. All owners of unit weeks in condominium units committed to interval ownership shall vacate their
            units no later than 9:00AM on the last day of their ownership period. Check in time is  3:00PM on
            the day which ownership period commences.

        15. Complaints regarding the service of the condominium shall be made in writing to the management
            firm, as long as the management agreement remains in effect and thereafter to Board of Directors.

        16. Payments of maintenance fees shall be made at the Office of the management firm, as
            designated in the management agreement. Payments made in the form of checks shall be
            made to the order of  Estero Island Beach Club AKA EIBC.                                      RESORT RULES AND REGULATIONS

        17. No unit week owner shall send employees of the association or management firm off the
            condominium premises at any time for any purpose. No unit owner or resident shall  direct,
            supervise or in any manner attempt to assert any control over the employees of the management
            firm or the association.

        18. The management firm, as long as the management agreements remains in effect, and thereafter
            the Board of Directors of the association, reserves the right  to make additional rules and
            regulations as may be required from time to time without consent of the condominium association
            and its members. These additional rules and regulations shall be binding as all other rules and
            regulations previously adapted.
                                                 GENERAL:

        Lockout fees after 2AM will be a minimum of $80.00. Lost key charge is $10.00. Lost security band is
        $5.00

        Pursuant to Estero Island Beach Club Condominium Association documents and bylaws:
        Any unit week owner or occupant who violates any provision of this declaration, the bylaws or rules
        and regulations of the association shall, in addition to other enforcement provisions herein provided,
        be subject to a fine of up to twenty-five and 00/100 dollars ($25.00) for each violation.

                                                DEFINITIONS:

        Unit Owner: Unless noted otherwise, the tern “unit owner” is synonymous with any occupant know as
        owner/owner guest/renter/exchanger/daytime guest.

        Common Elements: The portion of the condominium property not included in the units. Common
        elements shall include the tangible personal property required for maintenance and operation of the
        condominium, even though owned by the Association.

        Limited Common Elements: Includes those common elements, which are reserved for the use of a
        certain unit or units, to the exclusion of all other units.
